Complaints procedure

This is a translation for information purposes; in the event of any discrepancy, the Czech version prevails.

1. General provisions

This complaints procedure sets out how to assert rights arising from defective performance (a complaint) for goods purchased in the Play4Kids shop. The seller is:

2. Time limits for complaints

The buyer may report a defect that appears within two years of receiving the goods. If a defect appears within one year of receipt, the goods are presumed to have been defective at the time of receipt, unless this is excluded by the nature of the goods or of the defect. For buyers who are businesses, the seller states the period for asserting rights from defects at the time of sale.

3. How to make a complaint

You can make a complaint by e-mail to sadlik@play4kids.cz, by phone on +420 775 337 603, or in writing or in person at Slovenská 910, 685 01 Bučovice. To help us deal with it quickly, please state your order number, describe the defect and how it shows, and attach photos of the defect and of the whole product.

You do not need to send us roundabouts, spring riders or other bulky playground equipment. We will assess the defect from photos or, if necessary, arrange an inspection at the installation site. Smaller parts should be sent or handed over to the seller unless agreed otherwise.

The seller will confirm receipt of the complaint in writing – stating when it was made, what it concerns and how the buyer wishes it to be resolved.

4. Handling of complaints

The complaint, including removal of the defect, will be dealt with and the buyer informed within 30 days of the complaint being made, unless the seller and the buyer agree on a longer period. If this period expires without result, this is considered a material breach of contract and the buyer may withdraw from the purchase contract or claim a reasonable price reduction. The seller issues the buyer with a confirmation stating the date and manner in which the complaint was resolved, or a written justification if it is rejected.

5. Claims arising from defects

If the goods are defective, the buyer may request that the defect be remedied – at their choice by delivery of a new item without defects or by repair, unless the chosen method is impossible or disproportionately expensive. With playground equipment, a defect can often be remedied by replacing a part. If the defect cannot be remedied, or if it recurs or constitutes a material breach of contract, the buyer is entitled to a reasonable price reduction or may withdraw from the contract.

6. When a complaint cannot be accepted

Rights arising from defects do not cover in particular:

  • normal wear and tear and changes in appearance caused by outdoor use (for example fading of colours),
  • defects caused by installation not carried out by a competent person according to the manufacturer’s instructions, or by insufficient anchoring,
  • defects caused by neglecting regular inspections and maintenance in accordance with EN 1176-7 or the instructions,
  • mechanical damage after receipt, vandalism and damage caused by force majeure,
  • defects for which a lower price was agreed.

Wood is a natural material; uneven colouring, knots or small resin bleeds are not defects.

7. Costs of the complaint

If the complaint is justified, the buyer is entitled to reimbursement of the costs reasonably incurred in making it.
