Terms and conditions

This is a translation for information purposes; in the event of any discrepancy, the Czech version prevails.

1. Introductory provisions

These terms and conditions govern the mutual rights and obligations of the seller and the buyer when goods are sold and related services are provided through the Play4Kids online shop at play4kids.cz. The seller and operator of the shop is:

Provisions concerning consumers apply only to buyers who are consumers (Section 419 of the Czech Civil Code). If the buyer purchases in the course of their business or as a legal entity (for example a municipality, school or other organisation that states its company ID in the order), the provisions on consumer contracts and on withdrawal from a distance contract do not apply.

2. Online orders and inquiries

2.1 Goods on the website can either be ordered online (“Add to basket” button) or requested without obligation (“Add to inquiry” button). Each product shows which option is available. Installation, tailored sets and products priced “from” or “on request” can only be requested by inquiry.

2.2 An inquiry is neither an order nor a proposal to conclude a contract, and it creates no obligation to pay. Based on the inquiry, the seller sends a quote. A contract is concluded only when the buyer accepts the quote in the manner and on the terms stated in it; these terms and conditions apply to it accordingly unless the quote states otherwise.

2.3 Online orders. The presentation of goods in the shop is for information only and does not constitute a proposal to conclude a contract. The buyer orders goods by placing them in the basket, filling in their details and submitting the order with the button that entails an obligation to pay. Before submitting, the buyer can check and change the details entered and correct any input errors. By submitting the order, the buyer confirms that they have read these terms and conditions.

2.4 After submitting the order, the buyer receives an e-mail confirming that it has been received by the system; this message is not an acceptance of the order. The purchase contract is concluded when the seller’s order confirmation is delivered to the buyer by e-mail.

2.5 Delivery with the price to be confirmed. If the buyer chooses “Delivery within the Czech Republic – price to be confirmed”, the seller informs the buyer by e-mail of the shipping price and the total price of the order. In that case, the purchase contract is concluded as soon as the buyer confirms the total price by replying to the e-mail or pays it. If the buyer does not agree with the shipping price, no contract is concluded and the buyer pays nothing. The seller sends the payment details only together with the confirmed price.

2.6 Depending on the nature of the order (quantity of goods, price, expected shipping costs), the seller may ask the buyer to confirm the order additionally, for example by e-mail or phone.

3. Prices and payment terms

3.1 Prices are stated in Czech crowns (CZK) including 21% VAT; the seller is a VAT payer. Prices in euros are an indicative conversion only; online orders are paid in Czech crowns. The shipping price is shown in the basket or confirmed by the seller in accordance with Article 2.5.

3.2 Where a discount is shown for goods, the previous price is also displayed, i.e. the lowest price at which the goods were offered in the 30 days before the discount began (Section 12a of the Czech Consumer Protection Act).

3.3 The buyer can pay:

  • by bank transfer or QR code – stating the order number as the variable symbol; the seller dispatches the goods once the payment has been credited,
  • in cash on collection in Bučovice,
  • cash on delivery when the carrier delivers the goods.

3.4 The seller issues a tax document to the buyer and sends it by e-mail. The goods remain the property of the seller until the purchase price has been paid in full.

4. Delivery terms

4.1 The seller delivers online orders to addresses in the Czech Republic, using its own transport or a carrier; goods can also be collected in person in Bučovice by arrangement. The buyer’s billing address may be in the Czech Republic or in Slovakia. Deliveries to other countries can be arranged on the basis of an inquiry.

4.2 The seller usually dispatches goods in stock within a few working days of the conclusion of the contract or, for bank transfers, of the payment being credited. Made-to-order goods are delivered by the date stated in the order confirmation or the quote. Due to handcrafted production, the delivery time may exceptionally be longer; the seller informs the buyer of this without undue delay.

4.3 When goods weighing more than 40 kg per product are delivered (in particular roundabouts and spring riders), the buyer arranges handling equipment or a second person for unloading.

4.4 The buyer must inspect the goods on receipt. If the packaging is damaged or the goods are visibly damaged, we recommend refusing the delivery or recording the damage with the driver and informing the seller.

5. Installation

5.1 Installation is not part of the purchase contract unless agreed in writing in advance. Installation can be requested by inquiry, and the seller arranges it for an extra charge through a vetted installation company; the installation price shown on the website is indicative and the final price is set in the quote based on distance and the related travel costs.

5.2 If the buyer installs the equipment themselves, the installation must be carried out by a competent person exactly according to the manufacturer’s instructions and in compliance with building and safety regulations. The playground equipment must be firmly anchored, and a safety zone and a suitable impact-absorbing surface must be maintained around it.

5.3 The operator of playground equipment in a public space is responsible for its regular inspection and maintenance in accordance with EN 1176-7. On request, the seller can arrange the post-installation and annual main inspection.

6. Withdrawal from the contract

6.1 The buyer may cancel an order at any time before the goods are dispatched, by e-mail to sadlik@play4kids.cz or by phone.

6.2 A buyer who is a consumer has the right to withdraw from a purchase contract concluded online without giving any reason within 14 days of receiving the goods (for deliveries in several parts, of receiving the last part). The withdrawal can be sent to the seller’s address or e-mail; the online form or the model form may be used.

6.3 If the consumer withdraws from the contract, they send back or hand over the goods to the seller without undue delay and no later than 14 days after withdrawal. The consumer bears the costs of returning the goods, including for goods that by their nature cannot normally be returned by post (roundabouts, spring riders); the estimated cost of returning such goods is [TO BE COMPLETED: estimated return transport cost]. The seller refunds all payments received, including delivery costs (up to the cheapest delivery method offered), within 14 days of the withdrawal, but not before receiving the goods back or proof that the consumer has sent them. The consumer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

6.4 The right of withdrawal does not apply, among other cases, to goods made to the consumer’s specifications or clearly personalised (for example a product in a colour or size made to order) and in the other cases listed in Section 1837 of the Czech Civil Code.

6.5 If the seller cannot deliver the goods (for example because they are no longer produced), it informs the buyer without undue delay and refunds any amount already paid within 14 days at the latest.

7. Rights in case of defects and complaints

The buyer may report a defect that appears within two years of receiving the goods. If a defect appears within one year of receipt, the goods are presumed to have been defective at the time of receipt. The procedure for complaints, including the 30-day period for handling them, is set out in the complaints procedure. Wood is a natural material; uneven colouring, knots or small resin bleeds are not defects. For buyers who are businesses, the seller states the period for asserting rights from defects at the time of sale.

8. Out-of-court settlement of consumer disputes

The Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 796/44, 110 00 Prague 1, www.coi.gov.cz, is competent for the out-of-court settlement of consumer disputes arising from purchase contracts. Consumers may also use the European Commission’s information platform for consumers at consumer-redress.ec.europa.eu.

10. Final provisions

Legal relations not governed by these terms and conditions are governed by the laws of the Czech Republic, in particular the Civil Code and the Consumer Protection Act. If the buyer is a consumer habitually resident in another member state of the European Union, this does not affect the consumer protection provisions that cannot be derogated from under the law of that state. The seller may amend these terms and conditions; each order is governed by the version in force at the time it was submitted.
